General terms and conditions of sale - Comptoir des Millésimes

1/ Acceptance

All orders imply the buyer's unreserved acceptance and full and complete adherence to these general terms and conditions of sale and, is irrevocable and not subject to modification.
Orders are only final when the price has been fully paid to the seller. Offers are subject to stock availability, without commitment and except in the case of sale.
All the wines indicated on the site are in our possession in our cellars. If the bottles ordered were not in perfect condition, a photo of the actual bottle is available on the product page. When several bottles are available, the photo represents the bottle in less good condition (we are at your disposal for other complementary photos if needed).
In accordance with Article L. 3342-1 of the Public Health Code, by placing an order on the Site, you undertake to be eighteen (18) years of age or older at the date of the order.
In addition, you declare that you have the legal capacity to place an order on the website.

2/ Delivery and guarantee

To date, Comptoir des Millésimes ships to Metropolitan France and Corsica as well as to the following countries:

• France, Belgium, UK, Germany, Netherlands, Luxembourg, Italy, Spain, Austria, Denmark, Ireland, Portugal, Finland, Sweden, Hungary, Poland, Czech Rep, Slovakia, Romania, Bulgaria, Slovenia, Estonia, Latvia, Lithuania, Greece, Croatia.


The delivery cost is fixed and includes the guarantee of the package.
As soon as your payment is validated, your order is taken care of by our team within 24 hours. Shipments are made from Monday to Friday. The order will be sent to the address indicated during the validation.
In case of error in the wording of the recipient's details, the seller cannot be held responsible for the impossibility in which they could be to deliver the product. Although every effort is made to meet the deadlines indicated, these are given only as an indication. A delay in delivery shall not give rise to any penalty or indemnity of any kind whatsoever or to the cancellation of the order.

IMPORTANT :
Upon receipt of the products, it is imperative that you :
- control scrupulously the content of the parcel and to indicate your reserves if necessary. In the event of proven breakage, you must refuse the package to the deliveryman.
- inform us within 24 hours at the address indicated on the site. No complaint will be accepted after this period.
Guarantee: Each shipment includes a guarantee "to the value" in case of breakage or loss of the package. Attention : The guarantee does not cover the defects of the corks on old vintages.

3/ Return and withdrawal period

In application of the provisions of the article L.121-16 of the code of the consumption, the particular purchaser has 14 clear days, as from the reception of his order, to refuse the delivered articles.

In this case, the latter will have to be turned over, with the expenses of the purchaser, in their packing of origin, and will be refunded with the initial transport charges if they were not the object of damage, after reception and control. The exchange or refund of the order will be made within 30 days of receipt of the returned order. 

CHRONOPOST RELAY POINT CONDITION

- In case of delivery in a Chronopost relay point, the delay of the parcel is 7 days: the recipient will have 7 days to withdraw the parcel from the date of arrival in the relay point. 

- In case of return after this period of 7 days, the return costs will be charged to the buyer.

4/ Quality

Even if we take the greatest care in preserving the wines (temperature, hygrometry, obscurity), we cannot guarantee the irreproachable quality of old vintages. In accordance with international custom, the seller is not obliged to exchange corked bottles.

5/ Price and payment

All our prices are displayed in Euro including VAT.

Caution: In accordance with article 297A of the CGI (French General Tax Code), some products are subject to non-recoverable VAT (vat on margin).

- Payment by bank transfer:

As soon as your payment by credit card or bank transfer has been validated, your invoice will be available in your customer area, after logging in with your username and password chosen when you created your account.

- For orders paid by Paypal or American Express: the order cancellation and refund procedure, following the customer's request, will result in a 4% deduction of bank charges, deductible from the refund value.

6/ Confidentiality

Concerned about the protection of your privacy, Comptoir des Millésimes treats all information concerning you with the strictest confidentiality.
When you order, we need your name, your home or business address, your e-mail address, and if you order by credit card, your card number and expiry date. Access to your personal account is protected by a password that you choose when creating your account.
Comptoir des Millésimes complies with the provisions of the Commission Nationale de l'Informatique et des Libertés. In accordance with the French law "informatique et libertés" of January 6, 1978 modified in 2004, you have the right to access and rectify any information concerning you, which you can exercise by contacting :

Comptoir des Millésimes is responsible for the processing of your personal data. Generally speaking, the information you provide us with, with the exception of your password which is encrypted and can never be read, is intended for use by authorised Comptoir des Millésimes' staff who are the data controller. Your data is used to manage your access to your Comptoir des Millésimes customer account, and also for processing and tracking your orders, after-sales service for products ordered on our website, marketing and customer relationship management, collection and fraud prevention, reporting, steering, segmentation and marketing selection. The data concerning you is not transmitted to any third party service provider.

Commercial prospecting

Unless you expressly object, you may receive promotional offers from Comptoir des Millésimes by email. You can unsubscribe from the Comptoir des Millésimes Newsletter at any time by using the link provided for this purpose at the bottom of the email. As your data will not be passed on to other companies, you will not receive any offers other than from Comptoir des Millésimes.

8/ COMPETENT JURISDICTION

• In the event of an unresolved dispute between the buyer and SARL MSB Grands Crus, the French courts shall have jurisdiction.
• In the event of a dispute with professionals and/or traders, only the courts of LILLE METROPOLE shall have jurisdiction.
• The competence of the jurisdiction will be defined by the provisions of common law.
